Registered User Terms and Conditions

ANY PERSON OR ENTITY ("User") USING OR ACCESSING THE SERVICES AVAILABLE VIA THE SITE AT www.getpakt.com (“Site”) OR THE APP KNOWN AS “PAKT’ (“App”) MUST AGREE TO THE FOLLOWING TERMS AND CONDITIONS OF THIS REGISTERED USER AGREEMENT ("Agreement").

  1. 1. Contracting parties

    When you register with the Site or the App, you are contracting with PAKT Limited, a company registered in Chai Wan, Hong Kong. PAKT Limited is referred to in these terms and conditions as "we", "us", "our" or “PAKT”. You must be at least 18 years old to register with the Site and to use our services. We advise you to read and understand our terms and conditions carefully before using or services as, by using any services via the Site or the App, you accept and agree all the terms and conditions in this Agreement. All exchanges hereunder, verbal and written, will be undertaken in English language only.

  2. 2. Passwords

    You agree: to keep your Site password secure and confidential and to not allow anyone else (save for authorised third parties) to use your email address or password to access the Site; to not do anything which would assist anyone who is not a registered User to gain access to any secured area of the Site, and; to not create additional registration accounts for the purpose of abusing the functionality of the Site, or other users, or to seek to pass yourself off as another User. If you think someone else has obtained your account details, please let us know immediately and we will close your account as quickly as possible. You will be responsible to PAKT and to others for all activity that occurs under your registration account.

  3. 3. Your Personal Information

    You agree to provide only true, accurate and complete information to us and/or the Site. Any personal information provided by Users will be treated with appropriate care and security in accordance with our Privacy Policy. You agree to inform us immediately in writing of any changes to the information you have provided to us, including any changes to your billing details, contact details, alternative contact details, authorised persons, insurance details or access details.

  4. 4. Services

    PAKT (or its partners) provides storage, digitisation, consignment, transportation and additional services (“Services”) on your clothing and other wearables and accessories including (without limitation) apparel, footwear, handbags, accessories, suitcases/garment bags, golf clubs and storage and travel boxes (“Goods”). Each piece of apparel will normally constitute an item of Goods (and PAKT’s determination as to whether any presented item is in fact more than one item shall be final and no discussion will be entered into in this respect). The Services also include handling, storage, picking and packing, local collection and delivery, dry-cleaning, photography, website/mobile app usage, inspection and authentication. Whilst we do endeavour to provide the Services to multiple addresses (and, subject to additional charges, internationally), PAKT reserves the right to restrict the number of addresses for any single User. Please note that, until further notice, other than in respect of international shipping, the storage related Services are provided only in HONG KONG. Further details of the Services are set out on the ‘How it Works’ page on the Site. All services provided by PAKT are based on fair usage.

    PAKT X: X is an on-demand wardrobe extension for everyday use or seasonal management. Minimum contract is 3 months. PAKT X is available in different sizes and starts with PAKT Basic with 5 hanging garments or accessories. Each item will be inspected, UV sterilised and digitised.

    LITE Bags: Can be addded to any package for foldable items. LITE Bag measures 58x45x24cm; fits approx 65 T-Shirts. Weight limit is 15kg per bag. The contents are not individually inspected or digitised. LITE bags are delivered as one unit.

    PAKT LUXE: LUXE allows the User to store specialty garments including furs, wedding and evening gowns. Minimum contract is 1 month. Items are stored on hangers unless PAKT believes it is more appropriate to store the items carefully folded with acid free tissue paper in boxes fit for purpose. Each item will be inspected, UV sterilised and digitised. All collections are FREE of charge while deliveries incur costs as explained in point 5 below.

    PAKT TRAVELLER: TRAVELLER is membership based and designed for frequent travellers to Hong Kong who wish to travel luggage free. The Traveller can leave up to 10 hanging garments and 1 carry-on luggage as part of a capsule wardrobe in Hong Kong. Monthly fee is HKD 500 for a minimum of 6 months. Left items can be laundered and dry-cleaned and items will be delivered ready to wear, wherever needed upon next arrival in HK.

    In order to use most aspects of the Services, you must register for and maintain an active personal user Services account (“Account”). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account. Account registration requires you to submit to PAKT certain personal information, such as your name, email, address and mobile phone number, as well as at least one valid payment method (either a credit card or accepted payment partner). You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the Services or PAKT’s termination of these Terms with you. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by PAKT in writing, you may only possess one Account.

  5. 5. Collection and Delivery Policy

    Appointment hours: Mon-Fri, 10am-6pm and Sat 10am-2pm

    Booking deadline: Bookings for next-day appointments must be made by 4pm. Appointments made on Friday or Saturday can be fulfilled the following Monday.

    Special arrangement: There is no regular service available on Saturday after 2PM, Sundays & public holidays unless by special arrangement. All requests are subject to availability. Please contact us for requests.

    For appointments to/from outlying islands (Lantau Island, Lamma Island, Cheung Chau, Peng Chau) and other remote districts (Airport, Tung Chung District, and Others), please call for details.

    Wardrobe Extension

    • Collection: Complimentary
    • Standard delivery (under 50 items): HKD 99 + tunnel and parking fees
    • Round trip (collection + delivery, min. 5 items): Complimentary, except tunnel and parking fees
    • Urgent/same-day appointment (book before 11am): HKD 199 + tunnel and parking fees
    • Bulk deliveries (50+ items): HKD 300 surcharge (does not apply to final return delivery)
    • Walk up (after 1st floor): HKD 20 per floor
    • Self collection / delivery: Complimentary, must be arranged in advance
    • Early termination: If any account is closed within the first month, all collections and deliveries will be charged at the standard rates upon termination.

    Consignment

    • Collection (10+ items): Complimentary
    • Collection (under 10 items): HKD 99 + tunnel and parking fees
    • Return deliveries* (items unsuitable for sale): First return is complimentary. Subsequent returns at HKD 99 + tunnel and parking fees.
    • Recall requests: If you request an item to be returned to you 90 days or less from the date PAKT accepted the item, there will be a HKD 300 fee per item.
    • Counterfeit items: HKD 1,000 per item that is deemed counterfeit with no proof of authenticity.
    • *Please note we are unable to keep items unsuitable for sale for more than 90 days, after which you will be charged a monthly storage fee
  6. 6. Prices and Payment

    Prices of Services are as set out on the relevant pages of the Site and are subject to change at any time by posting new prices on the Site and include local taxes, unless otherwise stated. Unless otherwise stated, the listed prices do not include third party charges such as dry cleaning fees, repair fees, toll and/or parking fees (which will be chargeable in addition to the listed prices as incurred). Without limiting any other remedies or rights hereunder, we reserve the right to cancel or suspend our performance of the Services at any time until all outstanding sums are fully paid.

    Wardrobe Extension Service

    MONTHLY PLANS – Charged at each month after the first payment. Plans start from the date of the first collection. To terminate the service, you should inform us by telephone or by email, and we will endeavour to end the service as soon as possible, but no later than 30 days from receipt of notice. (See 24. Termination of this Agreement.)

    UPFRONT PLANS – 6-month and 12-month plans are charged upfront and will automatically renew unless instructed otherwise. Plans start from the date of the first collection. Depending upon the number of items and duration of the contract, there are free deliveries available each month. To terminate the service, you should provide at least 30-days' notice by telephone or by email, and we will endeavour to end the service as soon as possible, but no later than 30 days from receipt of notice. (See 24. Termination of this Agreement.)

    Consignment Service

    The service is free to get started. PAKT only receives a commission once you start earning. Once the sale is confirmed and after the buyer’s 14-day return window has lapsed, we will transfer the sales proceeds to your bank account at the end of the month, if not more frequently for higher price items. You can choose to be paid in money or PAKT credits. For details on commission structure, please contact us.

    Additional Services

    PAKT TRAVELLER – 6 month membership charged before the first collection, Roundtrip and additional services such as dry-cleaning will be charged as incurred. To terminate the service, you should inform us by telephone or by email, and we will endeavour to end the service as soon as possible, but no later than 30 days from receipt of notice. (See 24. Termination of this Agreement.)

  7. 7. Deposit

    For some services, a non-refundable advance payment (“Deposit”) may be required which, less any sums outstanding and subject to the other terms below, would be refunded following termination of this Agreement and/or the Services.

  8. 8. Refunds

    PAKT X – There are no refunds on 6 or 12 month packages paid upfront. If a user buys one package in January and then upgrades with another package in June, PAKT, together with the user’s agreement may choose to combine the two packages and offset any refunds accordingly. 30 days’ notice for termination of the Service is required (See 24. Termination of this Agreement.)

    PAKT LUXE – There are no refunds on 6 or 12 month packages paid upfront. If a User buys one package in January and then upgrades with another package in June, PAKT, together with the User’s agreement may choose to combine the two packages and offset any refunds accordingly. 30 days’ notice for termination of the Service is required (See 24. Termination of this Agreement.)

    PAKT TRAVELLER – There are no refunds on the initial 6 month membership package. A temporary stop of one month to the account is accepted with notice in writing or a telephone call to PAKT. (See 24. Termination of this Agreement.)

  9. 9. Your Obligations

    You agree to provide PAKT with accurate information and materials necessary to provide the Service to you, including without limitation details regarding collection and delivery locations (e.g. access by lift, stairs or particularly small or confined areas) and you agree to comply with our reasonable directions and to provide reasonable cooperation (including without limitation by allowing reasonable space and time for PAKT representatives to perform the Services at collection/delivery locations, pack and photograph the Goods, access and park at collection/delivery locations and any other acts or facilities as may be reasonably required by PAKT to perform the Services). Please note that, while we may in some instances collect from or deliver to custodians or office or commercial locations, we reserve the right to refuse the Services where delivery or collection is to or from a third party and/or where access is particularly difficult or inconvenient.

  10. 10. Preparing Goods for Storage

    You are responsible for ensuring that the Goods do not contain jewellery, precious stones, currency, bank notes, precious metals or alloys, evidence of debt (accounts, bonds or deeds), securities, hazardous cargoes (explosives, gases, flammable liquids and solids, toxic and infectious substances, oxidizing agents and organic peroxides, radioactive substances, corrosive substances), perishable, stolen or illegal substances, or any animal or other living creature. You must ensure that all pockets of each apparel item are empty prior to collection. The client should they not be present at time of collection or delivery- is responsible for ensuring that an authorised and suitable person is present at the collection/delivery location at the collection/delivery time and that such person is authorised to sign for the collection/delivery. Failure to do so may prohibit or delay handover and result in re-delivery/collection at an additional charge.

    The Client must ensure that when the Goods are presented for collection, they will be ready for PAKT’s staff to securely and properly pack (whether folded or hung) and in such condition as not to cause damage to the Goods or any person handling the Goods or to any other property, whether by spreading damp, infestation, leakage or the escape of fumes or substances or otherwise howsoever.

    PAKT reserves the right to determine if any particular item of Goods is fit and suitable for storage. Mouldy items will not be accepted unless dry-cleaned by the client which PAKT can facilitate. While we will use reasonable endeavours to make this determination at the time of collection, in some circumstances we may not be able to make a full determination until the item has reached the storage facility (and PAKT reserves the right to return one or more items of Goods at any time). A delivery charge may be incurred unless the Client is willing to wait until PAKT is in the neighbourhood on other deliveries/collections.

    LITE bag: You may choose either to pack the LITE bag in advance of pick up or request the PAKT team to pack on-site. You must ensure that you prepare all goods for storage in the PAKT LITE bag as required by PAKT, i.e. shoes in shoe bags and no heels, no furs, wedding and evening gowns.

  11. 11. Valuable and/or Fragile Items

    PAKT reserves the right, at our sole discretion, to refuse to provide the Services where rare and/or highly-valuable and/or fragile Goods or any other items deemed unsuitable are involved, or for any other reason. You agree to notify PAKT before (or at the time of collection) of any items that are of particularly high or sentimental value and/or that require special storage, transportation or handling requirements.

    LITE Bag: If items not allowed in the PAKT LITE bags are found in the PAKT LITE bags, it is the responsibility of the Client/Owner of the goods to pay for delivery of the items back to the Owner.

  12. 12. Reporting Damage to Goods

    You must inform PAKT of any damage to Goods within forty-eight hours of delivery and provide photographic evidence in accordance with the instructions on the Site. When Goods are returned, you agree to examine the Goods carefully and to tell us about any loss or damage to the Goods as soon as is reasonably possible after doing so. In any event, PAKT shall not be liable for any reported damage unless and until we have been provided access to inspect the Goods, have taken photographic evidence and/or had reasonable time to seek expert advice.

  13. 13. Self Collections and Deliveries to PAKT

    When You come to a PAKT storage facility and make deliveries and collections, you accept that PAKT requires adequate time to identify your Goods and to prepare them for check out.

  14. 14. Liability

    When you hand over your Goods to PAKT at collection, we shall transport and store the Goods with reasonable care and attention. While PAKT endeavours to provide the highest-possible quality standards of service, PAKT provides no warranty or guarantee that such quality of Service will be met at all times. You agree that the liability of PAKT to you hereunder shall be limited to the lesser of: (1) the amount you have actually paid to PAKT for its products or services; and (2) five hundred dollars (HKD 500) per item or HKD 1500 per box of goods lost or damaged (to an aggregate total of HKD 4000 per incident). Except as set out herein, PAKT shall not be liable for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of your use of this Site or in relation to the Goods and/or Services that we provide. Nothing herein is intended to limit or exclude liability for death or personal injury caused by the negligence of PAKT.

  15. 15. Insurance

    Goods stored by PAKT are not covered by insurance beyond PAKT’s own insurance coverage with Chubb. PAKT has been insured by Chubb without incident since 2015 and covers both in-transit insurance and warehouse/facility insurance against water and fire damage and theft. We recommend you insure all your Goods under your household insurance if possible, or please [contact us] for details of specialist itemised insurance (at additional cost). In all cases, in order to claim under PAKT Insurance, the age and original purchase cost of each item must have been specified at the time of the original order, and the original invoice for purchase must be submitted. Absent all such details, PAKT accepts no liability for any loss or damage to any Goods.

  16. 16. Third Party Services

    PAKT undertakes to recommend appropriate third party providers of laundry, dry cleaning, specialist cleaning and repair services for clients. PAKT will always endeavour to recommend high quality service providers, and although PAKT undertakes to manage the engagement of third party service providers, the decision to use any such services will be undertaken by clients at their own risk.

    PAKT assumes no liability for any damages to, or loss of, any client items resulting from any action or failure to act by any of PAKT's third party agents, vendors or service providers.

    In the event of a dispute, the individual third party service provider's terms and conditions will apply.

  17. 17. Indemnity

    You agree to indemnify PAKT for any loss or damage that may be incurred by PAKT including without limitation legal fees, arising from any breach by you of any warranty or other term herein or your misuse of any material or information obtained through the Site. You further undertake to indemnify PAKT for all loss or damage incurred by PAKT in relation to any third-party claim against PAKT for infringement of intellectual property rights arising in relation to your provision of materials to the Site.

  18. 18. Abandoned Goods

    Any Goods left unclaimed and unpaid for more than six months without prior notice and appropriate payment shall be disposed of without liability to PAKT. After three months, the goods will be removed from the PAKT ‘clean room’ storage with 24/7 climate and humidity control to other storage facilities that may not be adequate for long term storage of that Item of Goods. While PAKT will use reasonable endeavours to contact the Client before any such disposal, we cannot guarantee that we will be able to do so in every case. The Client agrees to ensure that you update your payment and contact details and your storage requirements, regularly.

  19. 19. Ownership of Goods

    You warrant the Goods you provide to PAKT for storage and/or handling is your own property (or that the person who owns or has an interest in them has given you irrevocable authority to store the Goods and that you are acting as an authorised agent of such person). You hereby indemnify PAKT against any loss or damage suffered by PAKT for breach of this warranty including against any loss, damage or expenses (including any reasonably incurred legal fees) arising from any step or action taken by any person who owns or has an interest in the Goods.

  20. 20. Late payment

    If you do not pay any fees or other sums owed hereunder within ten days after the applicable due date, you must immediately on demand pay an administrative charge for late payment of the greater of ten per cent of the outstanding sum or HKD 50. If your failure to pay continues for fifteen further days or more, the amounts outstanding shall incur interest at the rate of 5% above the best lending rate of HSBC Bank, calculated from the date when payment becomes due up to and including the date of actual payment including all accrued interest, whether before or after judgment. PAKT shall exercise a lien over your Goods for such debt until payment in full has been received. In the event that such debt is not paid ninety days after the due date (or you fail to properly arrange for delivery or collection of the Goods after notice), PAKT may sell the Goods (and pass all ownership) and use the proceeds of sale to pay first the outstanding debt and secondly to hold any balance for the Client (on which interest will not accrue). If the proceeds of any such sale are insufficient to cover all or any part of such debt, the client shall remain liable for the balance (on which interest shall continue to accrue). PAKT will give you notice of our intention to commence any such sale, and subsequently we sell the Goods by any method(s) reasonably available to achieve a selling price reasonably obtainable in the open market, taking into account the costs of sale. If the Goods cannot reasonably and economically be sold (for any reason whatsoever) or they remain unsold for any reason, you authorise us to treat the Goods as abandoned by you.

    LITE Bag: Failure to return excess PAKT pick up bags will incur a penalty of HKD 100. Failure to be prompt for the scheduled pick up will also incur a penalty of HKD 200 unless 24 hour notice is given. Failure to be at the appointed street level location for pick up may incur a penalty depending upon the driver’s waiting time.

  21. 21. Site Content

    This Site is intended only for the purposes specified on the Site, and your use of the Site and/or all content contained within the Site (“Content”) is entirely at your own risk. Please note, whilst we endeavour to provide accurate and up-to-date information, the Content may not be wholly accurate or up-to-date, complete or free of defects, and is subject to change, often at short notice. All Content is provided without any representations or warranties of any kind (implied or express) to the fullest extent permitted by applicable law and we will not be liable for any inconvenience, loss of revenue or any damages which result from the direct or indirect use of any information provided on the Site. If you find that some particular item of information is incorrect or has not been provided, please do not hesitate to contact us and we will try to rectify or provide the information as soon as reasonably possible. PAKT (unless otherwise stated herein) owns or controls all relevant intellectual property rights in the Site and the Content. You may not publish, distribute, extract, re-utilise, or reproduce any part of the Site or Content in any form (including storing it in any medium) other than as expressly allowed herein or as permitted on the Site or under Hong Kong SAR or local law. The Site and the Content are for your personal, non-commercial use only, and you may not use the Site or the Content for any commercial or competitive activity and you may not offer for re-sale any accommodation appearing on the Site.

  22. 22. Corporates

    PAKT aims to help our corporate customers with large orders. Please feel free to inform us of your requirements by [contacting us]..

    Corporate promotions have a minimum subscription period of 2 months in addition to the FREE storage period unless other terms are specified on the landing page and/or other promotional materials.

  23. 23. Objectionable Material

    If you encounter or become aware of any objectionable or infringing or unlawful content posted anywhere on the Site, please immediately report such material (and the specific page on which it is found) by [contacting us]. Please note that there may be adverse legal consequences if you make a false or bad faith allegation through this process.

  24. 24. Termination

    Either party may terminate this Agreement with 30 days’ notice. (See 5. Collection and Delivery Policy for delivery charges at cancellation.) Please contact us at [email protected] to give us notice of termination.

    PAKT may at any time terminate this legal Agreement if, in our sole discretion, we believe that a Client may have breached (or acted in a manner indicating that you do not intend to or are unable to comply with) any term herein, or if PAKT is legally required to do so by law, or if continuation is likely to be no longer commercially viable or desirable. In the event of any termination by either party, all outstanding sums will become immediately payable and, following settlement of all outstanding fees we will ensure all Goods in our possession are returned to the relevant location.

  25. 25. Trademarks

    The brands, products and service names used or appearing within the Site (including, without limitation, “PAKT") are the trademarks or trade names of PAKT or its trading partners unless otherwise stated. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trademarks, trade names or taglines without the prior written permission of PAKT.

  26. 26. Hacking

    1. You agree and undertake not to attempt to damage, deny service to, hack, crack, reverse-engineer, or otherwise interfere (collectively, "Interfere") with the Site in any manner. If you in any way Interfere with the Site, you agree to pay all damages incurred by PAKT. PAKT will cooperate with the authorities in prosecuting any User who Interferes with the Site or otherwise attempts to defraud PAKT or any other parties through your use of the Site or services provided via the Site. PAKT reserves the right to deny any or all access or service to any User for any reason, at any time, at our sole discretion. You agree that we may block your IP address or addresses at any time, and at our sole discretion to disallow your continued use of the Site. We reserve the right to take any action we may deem appropriate in our sole discretion with respect to violations or enforcement of the terms of this Agreement, and we expressly reserve all rights and remedies available to us at law or in equity.

  27. 27. No Partnership

    The use of the Site and/or its content creates no partnership, client, fiduciary or other professional relationship.

  28. 28. Entire Agreement

    This Agreement constitutes the entire agreement between the parties on the subject matter hereof. There are no understandings, agreements, or representations, oral or written, not specified herein regarding this Agreement.

  29. 29. Force Majeure

    PAKT will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control.

  30. 30. Severance

    If any part, term, or provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall still remain valid and continue in full force and effect.

  31. 31. No Waiver

    No waiver, express or implied, by either party of any term or condition or of any breach by the other of any of the provisions of this Agreement shall operate as a waiver of any breach of the same or any other provision of this Agreement.

  32. 32. Variation

    This Agreement may be varied from time to time by our posting new terms on the Site, and any such amendment will be applicable to all Users from the date and time such revised terms have been posted on the Site. Your continued use of the Site or services constitutes agreement with and acceptance of any such amendment or other changes.

  33. 33. Law and Jurisdiction

    This Agreement shall be governed by and will be construed in accordance with the laws of Hong Kong. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Courts of Hong Kong.
